DUI auto  accident with  personal injury ? Most likely outcome Felony Arrest!

Many people are going to get pulled over in the next couple of days in DUI Road blocks where the police set up and stop cars at random and do a quick check for most maybe a wave through or for others if they have suspicion a full on stop and if they see something that gives them probable cause a full car search including field sobriety tests like breathalyzers and road side sobriety checks.

 
What most people don't know is that there are rules that the police need to follow and if they break a rule and you have a good DUI lawyer you might even if you were legally intoxicated beat the charge or in many cases have it so that the charge is reduced using some DUI Defenses Field Sobriety Tests .  Like we have said many times before having a DUI defense that will make life hard for the DA is going to in many cases offer a plea bargain that could save your future. Driving While Intoxicated if you receive a conviction is a life changing event.

It is not a good idea to hire just old lawyer to handle your DUI case.  There are over 80 defenses that could be used to defend against a DUI charge .  If find a cheap lawyer that does not know all of the in's and outs of DUI defense  you may be missing chances to either have your case dismissed or to be found not guilty of the DUI or DWAI.

The DUI Laws and penalties the board are getting tougher and as a lot of communities are still not getting the ammounts of taxs that they were getting before 2008 so they are aggrasivly looking for ways to bring money into the coffers in Colorado traffic fines go straight to the Colorado Department of Revenue this is big business for a lot of people from the Criminal Defense lawyers to the judges to the food service providers to the jails all have a stake in this so don't get cuaght up in the machine .

1. Don't drink and drive.

2. If you do get cuaght make sure to do yourself a real big favor and shut up as everything you say and do will be used against you, count on it in real dollars you will forfiet for your indescresion.

3. If you hurt someone while under the influence of drugs or alcohol while driving you will be facing felony charges and long stays in either a county jail or in a state prison, not even nessesarily in your state!

4. Do yourself a big favor and get the best DUI lawyer you can find as soon as you can.

DUI and Uninsured motorist in Colorado

Personal Injury Car Accident

I was doing some research about auto accident personal injury and came across something that was crazy but makes sense. Lets say that you are walking across the street and a drunk driver clipped you and you went to the hospital and then you find out that he does not have insurance IF in Colorado you have uninsured under insured on your car insurance policy your auto insurance would need to cover you up to the limits of your auto policy.

What would happen if the same scenario that you got hit by a DUI or reckless driver and again they did not have valid auto insurance and you did not have auto insurance but had instead motorcycle insurance and that had uninsured under insured coverage would that pay now that is a very interesting question.

As I reading up on the new Colorado statutes from 2008 it says that the uninsured insurance follows the insured not the vehicle

If the at-fault driver doesn't have insurance, or does not have enough insurance, we look to your automobile insurance policy for compensation for injuries and losses. Under Colorado law, insurance companies selling automobile insurance in Colorado are required to sell Uninsured/Underinsured Motorist Insurance as part of every policy sold unless the coverage is specifically refused in writing. Uninsured or under-insured (UM/UIM) coverage is a separate coverage that provides coverage to you and your passengers if injured in an accident caused by an uninsured or under-insured driver. the above says auto insurance but when you look at the actual bill  that was passed  it says motor vehicle  later it defines  Motor vehicle in the law

"An under insured motor vehicle is a land motor vehicle, the ownership,
maintenance, or use of which is insured or bonded for bodily injury or death
at the time of the accident.... "

So my guess and remember I am not an attorney but just a normal guy is that if you had your tractor insured for Uninsured motorist that it would cover you if you were walking across the street and got hit by anybody, would not even need to be someone who was breaking the law in any other way than being uninsured. And it would also cover up to the highest limit available, as I read it, so if your policy was for say 250,000 and the injuries went past the guys legal minimum policy at 25,000, your insurance would cover you though his and up to the top of yours, so again as I read it, would make 275,000 available.

Brooke Mueller Arrest in Aspen Bothers Us

Sheen Trial at Pitkin County Courthouse will also for Mueller Trail if there is one.

It seems that she was arrested around midnight at Escobars, a new hot spot in Aspen, appropriately enough named after the famous Cocaine kingpin that was shot and killed many years ago.  The thing that bothers us about this deal, is that the person was allegedly hit by Charlies Ex Wife and they did not call the cops immediatly and I am also surprised that if this happened that the security at the Belly Up which is very good at what they do, did not get into this at all. Were they even notified that there was a incedent?

It just stinks to high heaven that this was a put up job maybe encouraged by the local police to  create some action on a slow night? or someone who knew who Brooke was saying, man you just got hit by a gold mine and egged them on? Where are the gruesome pictures of this Felony Assault?  Hell I bet I was hit harder than this by the nuns in my Catechism class and she never saw any 3rd degree assualt charges, But I tell you what if I saw here today with that pizza pie handle I'd still be afraid. LOL.

Anyway Brooke flew out Aspen from the ASE ABO at Atlantic Aviation on a private plane, where they recently had an employee on the airport ramp that was arrested as part of a coke ring that apparently according to the charges been around for 20 years based out of Aspen and LA.

So what will happen to Brooke when she gets back to Aspen the speculation is that as this is as first arrest that she will get probation and she will probably not lose the kids either.
